Terms of Service

These terms govern your use of Track40, a workflow management application provided by Track40 (“we”, “us”). By creating an account or using the service you agree to them. We may update them; substantial changes will be announced via email at least 30 days in advance.

The service

We grant you a non-exclusive, non-transferable right to use the service in accordance with these terms.

Your account

Sign-in is by one-time email link. You are responsible for keeping that inbox secure: anyone with access to your email can sign in as you. If you have also set a password, the same responsibility extends to keeping the password secret. You are responsible for all activity under your account; if you suspect unauthorised access, contactsecurity@track40.com and we will terminate active sessions. You must be at least 16 years old to use the service.

Teams and data

You retain ownership of all data you put in; we claim no rights over your pipes, cards, comments, or files beyond the limited rights needed to host and operate the service on your behalf. Team owners can invite, remove, and assign roles to other users. Data you contribute to a team remains in that team; if you leave or are removed, attribution becomes “[former member]” but the content stays. Team owners can delete their team at any time: deletion soft-removes the data immediately and hard-removes it after 30 days, after which recovery is not possible.

Acceptable use

You agree not to use the service to violate any law, regulation, or third-party right; to send spam or unsolicited bulk messaging through the email-to-card surface; or to attempt to reverse-engineer, gain unauthorised access to, or disrupt the service. Do not store or transmit sensitive personal data such as health records, government IDs, or payment card data. Track40 is not designed or certified for those workloads.

Plans and payment

Plans are charged monthly via Stripe. Per-card metered usage is drawn from a prepaid balance you top up; you control the top-up amount and a monthly cap. Imports (bulk-loading existing data) do not count against your metered usage.

If a payment fails, your card is retried automatically for around two weeks and access continues during retries. If payment cannot be collected the team is suspended: data stays readable, new writes are paused until payment is made, and nothing is deleted. Refunds are pro-rata for unused subscription time when you cancel mid-month, on request.

Service availability

We aim for high uptime but make no formal SLA at this stage. Scheduled maintenance is announced via email. We are not liable for losses arising from service downtime beyond a refund of the affected period’s fees.

Liability

The service is provided “as is” without warranties. To the maximum extent permitted by law, our aggregate liability for any claim arising from these terms is limited to the amount you paid us in the 12 months preceding the claim. Neither party is liable for indirect, consequential, or special damages.

Termination

You can cancel your subscription at any time from the team settings. We can terminate or suspend your account if you breach these terms; we will give notice and a chance to remedy unless the breach is severe, such as a security violation or illegal content.

Governing law

These terms are governed by the laws of New Zealand. Disputes go to the courts of New Zealand.
